第五次日韓会談の韓国側代表、兪鎮午は、回想「韓日会談が開かれるまで」(1966)によると、1951年4月(7日か?)朝日新聞紙上に掲載された日本と連合国との平和条約を読んでその内容が韓国に不利である内容があることに驚き、意見書を作成して韓国としての意見を主張する準備を始めます。彼はまず「歴史上から見て、我が領土として主張することが出来る島が、どれとどれであるかを知るため」、歴史学者であった崔南善のところを尋ね、以下のような助言を受けます。

1. 「独島の来歴を、即座に、私が確信を持てる程に説明してくれた」
2. 李承晩大統領
韓国の領土であると主張する対馬は「根拠が確実」ではないこと
3. 「木浦と日本の長崎、中国の上海を連結する三角形の中心となる海中に、「パラン島」という島」があり、「我が国の領土としてこの際に確実にしておくのが良いだろう」

意見書作成にあたって、「大韓民国が対日平和条約の署名国の一つとなることを要求する」ことは、「大統領の活動に一任することにし、ここには入れないことにした。」ようです。また意見書は、4、5個の条項から構成されており、領土問題中、「「パラン島」は、実存するかどうかが確実でなく、自信がなかったが、たとえ実存しないにしても、入れておいて害になることも無いだろうと して、独島とともに平和条約第二条に追加するように要求した。」とあります。意見書は外交委員会の委員たちと外務部長官卞栄泰との協力ももとに行われ、「特に、作成した意見書の英訳は、卞長官が直接に専担し、一字一字、精密に検討した。」後に、6月初め頃にはすでに大統領顧問である米国人が加筆した上で、すでに米国政府に送られたようです。

このように、1966年時点での兪鎮午の記憶によると、6月以前に作成された韓国政府による平和条約への意見書には対馬の要求は取り下げ、竹島と波浪島を韓国領土として明記するようアメリカに働きかける内容となっていたはずです。しかし、アメリカの公文書を確認すると、実際に韓国側からの米国への領土条項に関する要求は、1951年4月頃に歴史学者崔南善によって明確にその権原を否定されたにも関わらず、7月9日までは明らかに続いていたことが分かります。また、竹島(独島)と波浪島の要求は、韓国の梁裕燦米国大使より、ダレス国務長官顧問(後に国務長官を1953年1月21日 - 1959年4月22日の間つとめた。)に対して同年7月19日に突然行われますが、二島について知識がなかったアメリカ当局は、「ワシントン中捜したが、ドク島とパラン島を特定できなかった」し、「韓国大使館にも聞いたが、ドク島は鬱陵島または竹島の近くであろうパラン島もそうかもしれない」という全く要領を得ない回答を得ます。(新羅・朝鮮時代を通じて1947年になるまで韓国人は現竹島の領有権を宣言したことはただの一度もなく、当然その地図に領土としての記載がただの一度も無かったので、特定できないのは当然です。)そこで、1951年8月10日、米国国務次官補ディーン・ラスクは韓国外務省に対し、「独島、もしくは竹島、リアンクール岩として知られている島については、我々の情報によれば、日常的には人の居住しないこの岩礁は、韓国の一部として扱われたことはなく、1905年頃からは、日本の島根県隠岐島庁の管轄下にありました。この島について、韓国によりこれまで領土主張されたことがあるとは思われません。」と正式に通知します。

この兪鎮午「韓日会談が開かれるまで」(1966)は以後の戦後日韓関係を研究した著作によく引用されますが、15年後に回想録として書かれたものである為か、竹島問題を考える上で大変重要な事実関係についての錯誤があるようです。以下はこの兪鎮午の回想録を元に書かれたと思われる東亜日報の特集記事です。重複する点も多いのですが、対日講和条約の草案が、当時そのまとめ役となっていたダレス米国務長官顧問によって連合国並びに韓国を初めとする関係各国の意見を取り入れながら修正、作成されたという事実がある以上、韓国側の意見書の内容とその提出時期、米国の反応をより綿密に検討していくことは大変重要であると思われます。

独島領有権をめぐって韓日間紛糾しきり
対日平和条約草案に 所有権明記せず


日官憲 漁民慰霊碑破壊

1953年6月27日、日本島根県の官憲30余名が日本海上保安庁の巡視船に分乗し、独島に上陸して「独島遭難漁民慰霊碑」を破壊し「島根県島(訳注:隠岐が抜けている)五個村竹島」という・・を立てた。このような狼藉に、韓国政府は日本外務省に抗議するとともに、警察(警官)をして日本人がたてた独島日本領土権識を撤去せしめた。7月12日には日本島根県の第八海上管内の保安庁所属巡視船「へくら」が独島付近に接近し、韓国警備艇の銃撃を受けたこともあった。独島領有権をめぐる韓日間の紛糾は、このような頻繁な小規模衝突を誘発し、李承晩執権期間内に絶えることなく継続した。日本は独島問題について、1960年3月26日現在で41回の「対韓抗議」をするほどだった。韓日会談代表であり、特に対日平和条約草案の修正作業に参与した兪鎮午(ユ・ジノ)氏は「独島を平和条約に明記せずに残しておいたために紛争の種を残した」として「草案修正」作業当時を次のように回顧した。

1951年3月末、法務部法務局長の洪璡基(ホン・ジンギ)が、対日平和条約の草案を掲載した日本の朝日新聞をもって兪鎮午をたずねた。「草案内容中には、我が国の利害関係に関わる部分が少なくなく、帰属財産の処理規定は我が国に不利な結果を招来するようだ。」兪鎮午が、草案内容を検討した結果、帰属財産処理規定は、不利どころではなく、韓国にとって明らかに危険なものであった。草案4条A項の規定には、韓国内にある日本財産処理と日本内の韓国財産処理は、韓日両国間の「特別協定」で決定されることになっていた。「韓国財産の85パーセントにもなる帰属財産処理を日本と協議して決めろとは、これは韓国の独立を日本と協議して決めるのと同じこと」だと兪鎮午は考えた。帰属財産は、米軍政法令33号のより、米軍政庁に帰属し、「韓米間の財政および財産に関する・・協定」で、その財産一切を韓国政府が米軍政から譲渡されたものである。この協定で、帰属財産に関する完全な所有権をすでに取得しているので、日本とまたいかなる協議をする理由も、少しもなかったのである。「もし、日本がこの財産処理に関して何か言うことがあるとしても、それは財産を帰属せしめ所有した米国に対して言うことであり、韓国を相手にすることではない」というのが兪鎮午の見解であった。

帰属財産規定のほかに、草案2条の韓国領土についての規定も兪鎮午にとって不満であった。2条のA項には、韓国の付属島嶼として、済州島、 巨文島、鬱陵島だけが例示されており、韓半島の付属島嶼を全部列挙するのは不可能であるばかりでなく、不必要ではあるが、韓日間の紛争となりうる島嶼、例えば、独島のようなものは韓国の領土であることを平和条約の中に明記されなければならない、と考えた。日本の新聞にまで平和条約の草案が発表された以上、利害関係国である韓国にも草案を送付するであろうと、その事実を洪璡基に確認したが、「わからない」と言う。時を争う問題だと焦燥した兪鎮午は、数日前、駐米大使から新たに国務総理となった張勉から、「いつでも、どんなことでも、私に会う必要があれば、必ずたずね てきてほしい。どんなに忙しくても必ず会うから」と言われていたことを思い出し、張勉をたずねて、あれこれと平和条約草案について話し、韓国政府の意見書 を至急に作成して発送する必要があると強調した。張勉総理は、兪鎮午の主張を首肯したが、米国政府から送られた平和条約の草案が韓国政府に来てい るのかさえも知らなかった。秘書官たちに各方面を調べさせたが、誰も知らないと言った。問題の「草案」 の行方を捜すことができず、その日は無駄にしたが、2・3日後、張勉総理が兪鎮午を急いで呼ぶので、慶南道庁内の国務総理室をたずねると、ある書類を手にして・・して いた。「平和条約草案は、もう2週間前に大統領に届いていたのに、ある秘書の引き出しの中に今まで入れたままにしていたのだそうだ」

「草案」を手にした兪鎮午は、洪璡基とともに綿密に検討した。兪鎮午は、意見書作成の準備に着手し、まず初めに尋ねたのは崔南善であった。対馬は日本が奪取歴史上、韓国領土と主張できるのは、どの島であるかを知るためであった。六堂・崔南善は、記憶力がよく、独島の来歴について色々と根拠をあげ、兪鎮午が確信できるだけの説明をした。兪鎮午は続いて、対馬島について訊ねた。「李承晩博士が、対馬はわが領土だとしきりに言いますが、根拠が確実なことですか?」崔南善は、にこりと笑って首を左右に振った。対馬島に関して李承晩は、1948年8月20日、「我々は、対馬島を韓国に返還することを日本に要求する」と主張し、「対馬島は、上島と下島の二島からなり、韓日両国の中間に位置するものであるが、数百年前日本が奪取したものだ」と強調した。これより前、政府修立前の1948年2月19日、立法議院で、立法議員である許用亀ほか59人の署名を受け、対馬島朝鮮領土復帰建議を対日講和会議に建議しようとしたことがあった。提案理由は「対馬島は元来、新羅に属したもので、日本の長崎からは119マイルにもなるのに、釜山からは33マイルにすぎずに非常に近く、二つの主島からなるので「二島(トゥソム) と命名されたこと」などであった。(朴舜在 パク・スンジェ記者)

平和条約草案にパラン島追加要求
海上踏査の結果、実存せず、外交的失敗


島の名前さえも、明らかでなく

崔南善(チェ・ナムソン)は、諮問した兪鎮午(ユ・ジノ)に次のように言った。「木浦・長崎・上海を連結する三角形の中心の海中に「パラン島」があるが、島の表面が浅く、波の中に沈んだり現われたりするという。「パラン」とは、水が青い ことから言うのか、波の中に消えたり現われたりするので「波浪」というのか確実ではないが、いずれにしろ、その島を我々の領土としておくのが良いだろ う。」海図に「スコトラロック」(SCOTRA ROCK)という暗礁として表示された「パラン島」は、北緯33度10分東経120度に位置し、済州西南方180キロメートルであり、木浦から290キロ メートル、長崎から450キロメートル、上海から320キロメートルの海上にあって、この「島」が対日平和条約に明記されさえすれば、韓国の領域は済州の 西南方に大いに広がることになるのであった。対日平和条約草案の修正作業は、張勉(チャン・ミョン)国務総理と金俊淵(キム・ジュンヨン)法務長官が李承晩大統領に会って「帰属財産処理と領土問題は修正しなければならない」と懸命に説明したが、どうにもならなかった。李承晩大統領は、駐日連合軍司令官「ダグラス・マッカーサー」が自分にこの問題について善処すると約束したことをあげ「平和条約修正要求は必要ない」と反対した。政府側は、「ムチオ」駐韓アメリカ大使に会って平和条約草案の不当性を説明し、李承晩大統領を説得してくれるように要請した。「ムチオ」は、平和条約担当の米国大統領特使「ジョン・フォスター・ダレス」が「誤った考えを持っているようだ」として、協力することを約束した。

外務部の中に外交委構成

「ムチオ」の李承晩への説得が功を奏したのか、1951年4月16日、外務部の中に対日平和条約を扱う外交委員会を設け、草案修正のための意見書作成を開始した。委員は、金俊淵(キム・ジュンヨン)、崔斗善(チェ・ドゥソン)、裴廷鉉(ペ・ジョンヒョン)、兪鎮午(ユ・ジノ)などであり、監事は、洪璡基(ホン・ジンギ)、李建鎬(イ・ゴノ)などであった。意見書作成の過程で、韓国を平和条約の署名国の一つとして要求するのかについて論戦が起こった。署 名国になれば、日本に対し戦勝国の地位となり、戦争賠償はもちろん、その他の全ての問題で有利な地位に立つことになるが、これは純粋に外交的というよりは 政治的な性格のものであり、平和条約草案についての部分的意見を述べる意見書に含ませるのはふさわしくないと判断して含ませないことにし、その要求の成否 は大統領に一任した。意見書には、帰属財産と領土問題、漁業ライン問題などをのせた。特に領土問題の中で、「パラン島」の実存の当否は確実ではな かったが、たとえ実存しなくてものせておいて害になることもないだろうと結論し、独島とともに条約2条(済州島、巨文島、鬱陵島)に追加することを要求す ることにした。意見書は卞栄泰(ピョン・ヨンテ)外務長官が精密に検討し、直接英訳した。

1951年6月の初め。卞長官は外交委員達に、韓国政府のメモランダムをすでに米国政府に送ったと報告し、英文からなるメモランダム文書を配った。これを見た兪鎮午は、吃驚した。外交委員会が作成した意見書に非常に長い前文がつき、内容も1、2項が追加されており、前文は奇怪で本文で展開した法理論と相衝する(あいいいれない)内容のものがあった。「誰がこんなことをしたのだ」と問う兪鎮午に、卞栄泰は、大統領の米国人顧問「クルレン」が加筆したと答えた。加筆で問題が起こったので、卞栄泰は、配布したメモランダム書面を回収していったが、すでに米国政府に発送したあとであり、これ以上議論しても仕方がなかった。

意見書加筆で逆効果

メモランダムを送った結果、帰属財産と関連して平和条約の2条(訳注:4条の誤り)B項が新たに追加されたことは外交の大きな収穫であったが、「クルレン」が加筆をしなかったならば、米国がこのほかの要求事項を聞いてくれた可能性もあったと兪鎮午は残念であった。兪鎮午は、帰属財産に関する修正について、その後、韓日会談代表として参加して、手ひどい経験をしたと述べている。兪鎮午は、平和条約草案修正に帰属財産だけが反映され、その他のものはすべて拒否されたことは遺憾であり、「特に、独島を平和条約に明記しなかったことは、 長く続く紛争の種を残した処置であった」と述べ、「駐日連合軍司令部がマッカーサー・ラインを引く時にも、独島を「マッカーサー」ラインの外側にし、日本 漁船が独島にまで出漁できないようにしたのに、それを平和条約に明記しないことは理解しがたいことであった」と付け加えた。「パラン島」 は、1951年8月、韓国山岳会(会長洪鐘仁)が、海軍の協力を得て、海図に表示された海上(済州西南方180キロメートル)を探査したが、発見できな かった。兪鎮午は、平和条約草案修正対米メモランダムに「パラン島」が入ったことで、外交公文書に、実存しもしない島を領土だと主張して、取り返しのつか ない失敗をしてしまった」と回顧している。(朴舜在パク・スンジェ記者)

日本政府、独島が表示された韓国の切手発行に抗議
日本の海上巡視船 被撃事件も議論に


新種類500万枚ずつ発行

独島領有権をめぐる韓日間の紛糾は、独島が表示された切手にまで広がった。逓信部が1954年9月20日に、独島の風景をのせた2ファン、5ファン、10ファンの新切手を各500万枚ずつ発行すると、日本の外務省は抗議をしてきた。「日本外務省は、駐日韓国代表部の対し韓国政府が発行した、日本の領土である「竹島」が表示された切手について、次のように抗議する。韓国から最近日本に郵送されてきた郵便物に、日本領土である「竹島」が表示された3種類の切手が貼られている。切手には韓国語で「大韓民国郵政」という語とともに「独島」と印刷されている。日本政府は、何度も、韓国政府に対し、明確な日本領土である「竹島」を韓国が不法占領していることを抗議してきた。韓国政府が日本政府の抗議を引き続き無視し、ここにきて「竹島」が表示されている切手を発行することは、韓国政府が日本の領有についての傲慢な主張を宣伝するためのものだ。日本政府は韓国政府の非友好的行為に厳重に抗議するものであり、その是正を要求するものである。日本政府は日本の島である「竹島」が表示されている韓国の切手について、とることの出来るすべての措置を留保している所である。」

韓国政府に通告するこのような日本政府の抗議を駐日代表部は次のように一蹴した。「日本外務省は、口上書で、韓国政府の独島占領についての日本政府の抗議を韓国政府が継続して無視したというが、日本政府は韓国政府が独島が韓国領土であることを、何度もはっきりと明らかにしていることを想起すべきである。韓国政府は、特に1954年9月25日付けの、駐日代表部覚書で、国際法上も歴史的記録からも独島が韓国領土であるという充分な証拠を提示したと深く信ずるところである。韓国が独島に領土管轄権を適法に行使することは、疑心の余地なき確固としたものである。よって、日本外務省が韓国の独島「不法占拠」を云々する主張は、まったく根拠がないことを認証するものだ。「独島切手」発行について、日本外務省は、韓国政府が独島領有についての傲慢な主張の宣伝をする企図だというが、前にも指摘したとおり、独島は韓国領土であることが明らかであり、「独島切手」発行は韓国政府の管轄権に属するものである。

日本政府政府の態度は内政干渉

韓国の切手発行についての日本政府の態度は、不当な韓国への内政干渉と変わらない。上に言及したごとく、駐日代表部は、日本政府が明白な韓国領土である独島を表示した切手発行について抗議する立場にないことを確信するものである。」日本外務省は、「独島切手」以外にも独島近海における日本海上保安庁の巡視船「被撃」事件についても抗議してきた。

1954年11月30日付の抗議口上書

「日本外務省は、駐日韓国代表部に対し、日本領土である「竹島」を不法占有中の韓国官憲により日本海上保安庁巡視船が不法な砲撃を受けたことについて、次のように抗議するものである。海上保安庁の巡視船「おき」と「へくら」は、1954年11月21日の朝、巡視のため「竹島」近海に到着した。「へくら」が「竹島」の西北方3マイルの海上に接近した時、その島を不法占領中の韓国官憲が午前6時58分から7時の間に5発の砲撃を加えた。「竹島」領有権紛争の平和的で最終的な解決のため、日本政府は、韓国領土に対し、国際司法裁判所に提訴することを提議したことがある。韓国は日本の提議を拒否したばかりでなく、「竹島」に警備兵力を駐屯させた。韓国はこれまでその島の不法占領を継続しており、駐屯官憲が日本船舶に発砲までした。日本政府は、韓国政府のこのような行動の継続は国際平和と安全をおびやかすものであるとの深刻な憂慮をせざるを得ない。日本政府は、韓国政府官憲のこのような不法に対し、強く抗議を提起するとともに、「竹島」から韓国官憲の即刻的な撤収を要求するものであり、銃砲を含む全ての装備の撤去も求めるものである。日本政府は、また韓国政府の公式的な謝罪を要求し、今後このような不法行為が再発しないように、砲撃事件を起こした責任者を即刻的に処罰することを含む法的措置をとることを要求するものである。日本政府は、もし韓国政府が日本政府のこのような要求を引き続き拒否するならば、この問題によって惹起されるすべての紛糾の責任は、全て韓国にあることを宣言するものである。」(朴舜在 パク・スンジェ記者)

The Korean Ambassador then asked whether the Islands of Tsushima was to given to Korea under the terms of the treaty, stating that Tsushima properly belonged to Korea. Ambassador Dulles took exception to this statement and pointed out that Japan had been in full control of Tsushima for a very long period of time; the treaty therefore did not affect the present status of Tsushima as a minor Japanese island.

1951 - 7月12日 韓国政府は七月一二日、条約草案に書かれている連合国の中に韓国を含めること、日本が対馬に対する権利を放棄すること、韓日間のすべての条約を無効とすること、など一〇項目からなる覚書をアメリカに送った(東亜日報、七月一三日)

1951 - 7月18日 再度、①韓国を対日戦に参加した交戦国と認めること、②日本は韓国に対して、政府所有と個人所有を問わず、すべての財産請求権を放棄する こと、③韓国を対日講和の調印国とすること、④韓国と日本との間の漁労水域を明白に決定すべきこと、⑤日本は対馬、波浪島(実在しない島であるが、当時、 韓国政府部内では存在するとされていた)および東海(日本でいう日本海)内にある独島に対する要求を放棄することなど五項目の覚書をアメリカに提出した (東亜日報、ニニ日)。

Mr. Dulles noted that paragraph 1 of the Korean Ambassador’s communication made no reference to the Island of Tsushima and the Korean Ambassador agreed that this had been omitted. Mr. Dulles then inquired as to the location of the two islands, Dokdo and Parangdo. Mr. Han stated that these were two small islands lying in the Sea of Japan, he believed in the general vicinity of Ullungdo. Mr. Dulles asked whether these islands had been Korean before the Japanese annexation, to which the Ambassador replied in the affirmative. If that were the case, Mr. Dulles saw no particular problem in including these islands in the pertinent part of the treaty which related to the renunciation of Japanese territorial claims to Korean territory.

1951 - 7月26日 韓国がアメリカに対して三たび講和条約案の修正を要求した。①韓国内の日本および日本人の財産(請求権・債権)を放棄すること、②日本に ある韓国および韓国人の財産は日本にある連合国民の財産と同様に返還されるべきこと、③新たなる漁業協定が締結される時まで、マッカーサー・ライン(マッ カーサーが軍事統制と日本漁船の操業制限のために引いた線)を存続させるべきこと、などである(東亜日報、ニ八日)

1951 - 8月2日 韓国の梁裕燦大使からアチソン国務長官へ書簡:第4条の日本による財産請求権の放棄、第9条にある漁業協定が締結されるまでのマッカーサーライ ンの存続、第21条に第15条(a)を加えることを要求。(問題の日本が放棄する領土を規定した第2条には言及しないが、第21条には韓国が第2条での利 益を受ける権利を有する、とされている。)

1951 - 8月3日 Mr.Robert A Feareyのメモ:国務省情報局のBoggsがワシントン中捜したが、ドク島とパラン島を特定できなかった、韓国大使館にも聞いたが、ドク島は鬱陵島または竹島の近くであろう、パラン島もそうかもしれない、とのことであった

兪鎮午(ゆ ちんご、ユ・ジノ、1906年5月13日 - 1987年8月30日:左の写真_Copyright (c)한국민족문화대백과)は「朝鮮の小説家、政治家。号は玄民。初期はプロレタリア作家、中期は純粋文学、そして後期は親日派として日本の植民地時代を翻弄した。解放後は、韓国において法学者、政治家として活動した。大韓民国憲法の起草者でもある。」人物であるとのことです。(Wikipediaによる)
また、後に日韓の国交正常化交渉の際に、李承晩政権崩壊後の1960年10月から再開された第五次日韓会談の韓国側代表にもなりました。

「一九六〇年四月、李承晩政権が退陣してから、韓国には日本との間に友好親善関係を求める機運が急速に拾頭した。張勉新政権はその施策の重点の一つに日本との国交正常化をかかげ、日韓会談の妥結にきわめて意欲的であった。これに呼応して日本側にもこの機に多年にわたる諸懸案を早急に解決すべきであるとの声が高まった。 かかる情勢の下に、小坂外務大臣は同年九月はじめ、戦後初の公式使節として、韓国を訪問し、鄭外務部長官との間に、日韓全面会談予備会談を開くことに合意した。 かくて第五次日韓会談は日本側から沢田廉三首席代表、韓国側から兪鎮午首席代表をたてて、同年十月から翌年五月まで、約七カ月間にわたって東京において開催された。会談の進行状況は、諸懸案の内包する問題の複雑さと動揺する韓国の国内情勢のため、必ずしも十分満足できるものではなかったが、四月中旬には、あと一カ月で予備会談を打ち切り、その後日韓双方がそれぞれ国内調整を行なった上、九月ごろに本会談を開いて、高度の政治的観点に立った解決をはかるのが適当であると判断されるまでになっていた。 このときに当たり、突如五月十六日、韓国に軍部によるクーデターが発生し、張勉政権が倒れたため、日韓会談はここにまた中絶のやむなきに至った。 」外務省のサイトより)

以下は、兪鎮午による回想録である、「韓日会談が開かれるまで」(上下)(韓国の雑誌『思想界』1966年2月号・3月号に掲載された)のうち、"上"の部分のmatsu氏による日本語訳です。(matsuさん、有難うございました。)原文画像を載せましたので、内容とともに皆で検討していきたいと思います。よろしくお願い致します。(なお、文章中に出てくる洪璡基という人は、新聞中央日報の会長だったようです。)

兪鎮午「韓日会談が開かれるまで」(上)『思想界』1966年2月号
―前韓国主席代表が明らかにする14年前の曲折―

14年もの間、韓日会談が続いたために、これに関係した人士は数百を越えるものと思う。私もその中の一人として、1951年10月、韓日会談が開かれるまで一部の責任を果たした。第5次会談の時には主席代表の役割を務め、会談についてはさすがに語るべきことがないわけでもない。しかし、これに関する充分な資料が今手元にない上に、その当時は日記もつけていなかったので、すべて記憶に頼るのみであることが遺憾である。すでに少なくとも15年以前のことについての回想であり、錯誤もあると思うが、それは明らかになった後の訂正を待つほかはない。

一 対日賠償要求調書

わが政府が、対日関係において行動を取る必要を感じ、その準備に着手したのは、政府が樹立された直後の1948年秋のことである。政府部内で誰がそんなことを先唱したのかは今記憶がないが、当時、企画処長であった李順鐸(イ・スンテク)氏と、法制部長であった私が、数次、これについて意見を交換したものと記憶している。わが民族は、36年という長い間、日本の一方的な独占により莫大な被害を受けたが、独立政府が樹立された以上、我々は当然日本に対して賠償を請求しなければならないということであった。
当時、我々が考えた「賠償」は、もちろん国際法上の「戦時賠償」であった。しかし、当時は日本と平和条約を締結した国はまだなく、今後賠償問題がどのように取り扱われるのか不明だったため、我々はただ、そのような問題が具体化される時に備え、わが政府としての準備をしておこうという漠然としたものに過ぎなかった。その上、わが政府部内には独立の闘士や学者出身はいても、国際外交の実際の経験をもつ人間はおらず、そのような問題を、どのような時期に、どのように取り扱うべきかも漠然としたものだった。
しかし、いずれにしても、対日賠償要求調書は急いで作成しなければならないとして、企画処長の総括下に、政府各部をして夫々の所管事項についての対日賠償要求を提出させるようにしたが、その結果として出来上がったのが、対日賠償要求調書の二巻である。
その第一巻は、1949年3月15日に完成したが、その内容は、1949年3月1日現在で判明した現物被害(地金、地銀、書籍、美術品および骨董品、船舶、地図原版、その他)について、我々が返還を要求する現物の目録であった。
第二巻は、その年の9月にようやく完成したが、その内容は、第二部、確定債権(戦争とは直接関連がない単純な債権債務関係)。第三部、中日戦争および太平洋戦争に起因する人的、物的被害。第四部、日本政府の低価収奪による損害(所謂、強制供出による損失)からなっていた。
上の二巻の中の第一巻、すなわち、現物返還要求については、作成後、まもなくマッカーサー司令部に送られたことは知っているが、私は、その年の6月に法制部長を辞任したため、第二巻の内容がどのように取り扱われたのかは知らない。
対日賠償要求調書を作成した当時には、先に述べたように具体的にそれをどうしようという計画はなかったが、今になって考えてみれば、それが韓日会談を開くためのわが政府の重要な基礎作業だったと思う。なぜなら1950年6月には共産南侵のため政府が釜山に遷都したため、この調書が無かったならば1951年に韓日会談を開くのは難しかったと考えるからである。
避難生活の混乱の中で、対日賠償要求調書のような、旧文書を調べなければならず時間のかかる文書を作成することは、不可能に近かっただろうからである。


二 サンフランシスコ平和条約草案

政府を辞職したあと、私は、教育法基礎など教育部分を除けば、政府の仕事には特に関与せずにいたが、1・4後退後、数か月たったある日(3月末ごろと記憶するが4月はじめだったかもしれない)、当時法務部の法務局長であった洪璡基(ホン・ジンギ)氏が、日本の新聞1紙を持ってやってきた。対日講和条約の草案の訳文が掲載されていたが、それを見れば、我が国の利害に関係する部分が少なくないばかりか、帰属財産処理についての規定は、まかり間違えば我が国に非常に不利であるようだとのことであった。
洪璡基氏とともに検討してみると、果たして彼の言うとおりであった。帰属財産についての草案の規定は、不利などころではなく、我が国にとって明らかに危険なものであった。草案によれば、帰属財産は、草案第四条A項により処理されることになっているが、同項によれば、韓国内にある日本および日本国民の財産(すなわち帰属財産)の処理と、日本内にある韓国および韓国国民の財産の処理は、韓日両国間の「特別協定」により決定されることになっていた。
韓国の全財産の80パーセント、90パーセントともなれば、帰属財産の処理を日本と協議して決定するとは、まさに韓国の独立を日本と協議して決定するということと同じことではないか!
周知の通り、帰属財産は、米軍政法令第33号により、米軍政庁に帰属し(vested)所有された(owned)ものであり、その後「韓米間の財政及び財産についての最初協定」(1949.1.18.条約第一号)により、その財産に関する一切の「権利、名義、および利益」は、わが政府が米軍政から譲渡されたものであった。ちょうど私は、政府樹立直後に始まった前記の協定締結のための協議に最初から最後まで参席しており、(我が方の主席代表 李範奭総理、代表 金度演財務、張澤相外務、李順澤企画、兪鎮午法制、米側主席代表 ヘルミック准将)、帰属財産についての法理に比較的明るかった。我が国は、前記協定により、帰属財産についての完全な所有権をすでに取得していたのであり、日本側と改めていかなる協議もするべき理由は少しも無かったのである。たとえ、日本側が同財産の処理について何か言いたいことがあるとしても、それは、その財産を帰属させ、所有した米国に対してなされるべきことであり、我々を相手とすることではないという見解であった。
帰属財産についての規定の他に、草案第二条の、我が国の領土についての規定も私には不満であった。第二条A項には、我が国の付属島嶼として、済州島、巨文島、鬱陵島だけが例示されていたが、韓半島の付属島嶼を全部列挙することは不可能であり、また不必要なことであるが、韓日間の紛争がありうる島嶼、例えば独島のようなものは、我が国の領土であることを平和条約の中に明記しておかなければならないと思われた。
日本で新聞にまで条約草案が発表された以上、重要な利害関係国である我が国にも、その草案が送付されて来ているものと思われ、私は洪璡基氏にそのような事実の有無について訊ねたが、わからないという答えであった。時を争う問題であり、どうしたら良いか考えていたが、ちょうどその数日前に、駐米大使から帰国した新任の張勉総理に会った時に、「いつでも、どんなことでも、私に会うべきことがあれば訪ねて来い。どんなに忙しくても、必ず会う」と言っていたのを思い出した。新たに外務部長に任命された卞栄泰氏は、国連代表として、まだ帰国していない時であった。
その二日後の朝、私は慶尚南道道庁の中にあった国務総理室に張勉博士を訪ねて行った。喜んで会ってくれた張総理に、私はいきなり平和条約草案についての話をし、わが政府としても、急いで意見書を作成して送る必要があると言うと、彼も私の言葉に全く同意してくれた。それならば、米国政府から送ってきた草案の写本があるはずであるが、そのようなものが我が政府に来ているのかどうか、張総理も知らないでいた。秘書官に命じてあちこち調べさせたが、そんなものは誰も知らないということであった。
米国政府から平和条約草案を、重要な利害関係国である我が政府に送って来ていないことに対して私は非常に失望し、また不快に思ったが、たとえ、いかなる理由で写本を送って来ないにせよ、我が政府としては必ずそれに対する意見書を提出しなければならないと考え、私はすぐに意見書作成の準備に着手した。
その第一番にたずねて行った所は、崔南善氏の家であった。(その時、東莱方面にたずねて行ったようであるが、確実ではない)。歴史上から見て、我が領土として主張することが出来る島が、どれとどれであるかを知るためである。六堂(訳注:崔南善の号)は、果たして記憶力が良い方であり、独島の来歴を、即座に、私が確信を持てる程に説明してくれた。次に、私は対馬島について、「李博士は、対馬島も我が国の領土だと何度も言っていますが、根拠が確実ですか?」と訊ねると、六堂は声を立てずに笑って首を左右に振った。ところがそのかわり、六堂は、私に新たな知識をひとつ与えてくれた。我が国の木浦と日本の長崎、中国の上海を連結する三角形の中心となる海中に、「パラン島」という島があるが、表面が非常に浅くて、波の中に埋もれたり、現われたりするということだった。「パラン」というのは、草(プル 水ムルの誤植か?)が青く・・・してする語なのか、波の中に入ったり、現われたりするので「波浪」というのか、確実ではないが、いずれにしても、それは我が国の領土としてこの際に確実にしておくのが良いだろうということであった。六堂の言葉に私が狂喜したことはもちろんである。もし、この島の名前が対日平和条約の中に明記されることになれば、我が国は済州島の西南方に大きく領域を広げることになるのだから。
二三日後、張勉総理から緊急の連絡があって行って見ると、何かの書類を手にして、「もう二週間前に大統領の所に来ていたのに、ある秘書の引き出しの中に今までほうり込んで置いたままにしていたんだそうだ。チッ チッ。(舌打ち音)」と不機嫌に言った。書類は、もちろん、数日前から捜していた、米国政府から送られてきた対日平和条約草案であった。私は、国事をこのように処理することがありうるのか、とあきれて物も言えなかったが、いずれにしても良かったと思い、そのまま草案について洪璡基氏とともに内容を研究・検討しはじめた。

当時、このことについて政府部内で我々に最も理解を示し、協力してくれたのは、金俊淵(キム・ジュニョン)法務部長官であった。彼は、張総理とともに、我々の意見に全面的に同調し、国務会議(閣議)の席上でも、欠席中の外務部長官に代わって我々の意見をおおいに代弁してくれた。
しかし、すぐに我々は難関に突き当たった。張総理、金法務などが、帰属財産についての法理をいくら説明しても、李大統領は、「マッカーサー将軍が私に約束した言葉がある」として、平和条約草案の修正を要請するのに賛成しないということであった。
仕方なく、我々はムチオ大使を動かす努力を始めた。その時、誰がムチオ大使にあったのか確実な記憶が無いが、崔斗善(チェ・ドゥソン)氏などがしたことだと思う。ムチオ大使は、すぐに我々の言うことを理解してくれたそうである。
ムチオ大使が、その後、李大統領に会い、説得を試みたかどうか、私は知らない。しかしいずれにしても、李大統領もわれわれの意見に賛成するようになり、我々は外務部の中に「外交委員会」というものを構成し、我が政府の意見書を作成しはじめた。その時、委員として参席した人は、金俊淵(キム・ジュニョン)法務、崔斗善(チェ・ドゥソン)、裴廷鉉(ペ・ジョンヒョン)、洪璡基(ホン・ジンギ)、李建鎬(イ・ゴノ)、朴在隣(パク・チェリン)、そして私、などであった。
意見書作成にあたって、まず第一に問題になったのは、大韓民国が対日平和条約の署名国の一つとなることを要求するのか、ということであった。もし我が国が平和条約署名国の一つになりさえすれば、我々は日本に対し戦勝国の地位を持つことになり、したがって戦争賠償を受けられるのはもちろん、その他のあらゆる問題について絶対的に有利な位置に立つことになるからだった。しかし、この問題はあまりに政治的であり、また重慶臨時政府時代以来、散発的に何度も論議されてきたことであったため、すでに作成された草案に対する部分的意見書に含ませるにはあまりに重大であったので、大統領の活動に一任することにし、ここには入れないことにした。
意見書は、4、5個の条項から構成されていたが、帰属財産問題と領土問題の他のものが何であったのかは、今は覚えていない。領土問題中、「パラン島」は、実存するかどうかが確実でなく、自信がなかったが、たとえ実存しないにしても、入れておいて害になることも無いだろうとして、独島とともに平和条約第二条に追加するように要求した。
そうしているうちに、卞栄泰(ピョン・ヨンテ)新任外務部長官も帰国して執務するようになり、外交委員会の委員たちとともに意見書作成に協力した。特に、作成した意見書の英訳は、卞長官が直接に専担し、一字一字、精密に検討した。
意見書の英訳まで終えた私は、再び私の仕事(戦時聨合大学のこと、海軍法務監室で米国海軍関係の法典を翻訳すること等)に専心していたが、ある日(いつであったか確実ではないが、6月初め頃ではなかったかと思う)、久しぶりに外交委員会を開くというので出向いたところ、卞外務長官から我が政府の意見書はすでに米国政府に送ったという報告があった。私はとても満足した。しかし、席上で配布された意見書の写本(英文)を見て、私は憤慨した。委員会で作成した意見書に、非常に長い前文をつけ、内容も、1、2項目追加されていたが、その前文なるものは奇怪で、本文で展開した法理論と相衝する(あいいれない)内容であったからだ。誰がこんなことをしたのか、と言うと、大統領顧問である米国人が加筆したものだという答えであった。私は、非常に不快であったが、もうどうすることもできなかった。
それはそれとして、我が政府で意見書を送った結果として、対日平和条約の第四条にB項が追加されたことは、我々の外交の大きな収穫であった。その後、韓日会談を通して我々が骨身に染みて経験したところであるが、新設されたB項に、日本は米軍政庁が帰属財産について行った処分(帰属、所有、およびわが政府への譲渡)の効力を承認すると明示されているにもかかわらず、そのまま、その財産に対して今だに「請求権」なるものを持っていると、止むことなく主張し、何度も会談を決裂させたのであるが、もし、その条項が新説されていなかったならば、どんな主張を持ち出してきたのか分からないのである。
帰属財産についてのことだけが採択され、それ以外の我が政府の意見は、すべて拒否されたことは遺憾なことであった。特に、独島を平和条約の中に明記しなかったことは、長く続く紛争の種を残した処置であった。日本占領軍最高司令部が、当初いわゆる「マッカーサー線」を引く時にも、彼らは独島を「マッカーサー線」の外に置いたのであり(すなわち、日本の漁船が独島まで来る事ができないようにしたのであるが)、ここへ来てそれを平和条約の中に明記しなかったことは、理解することができない処置であった。しかし、そうだとしても、それをもって米国が独島を日本領土と考えているとは、もちろん解釈されない。鬱陵島に付属した小岩礁にすぎないので特記する価値がないものと見た結果にすぎないのである。
パラン島は、その年の夏、韓国山岳会の洪鐘仁(ホン・ジョンイン)氏が主導し、わが海軍の協力のもと、日本海軍水路部で発行した海図を持って実地探査したのであるが、ついに発見できずに終わった。忽忙中、不得意なことであったが、国家の権威を象徴する公式の外交公文書に、実存しない島の名前を書き、我が領土だと主張したことは、取り返しのつかない失敗であった。
そうこうするうちに、政府部内では、韓日会談開催の機運が熟してきた。我が国は、対日平和条約の関係国として、同条約により、請求権、海底電線、漁業、通商航海などの自らの問題を日本と協議・解決するようになっているばかりでなく、日本における僑胞処遇問題、解放後の密入国者の強制送還問題、船舶問題などで、当時すでに駐日代表部とSCAP間で交渉が進行中であり、それがわが国会でも問題になっていたからである。

2010 - Feb. 22 - Happy Takeshima Day !!

Today, the Shimane Prefectural Government marked its fifth "Takeshima Day(竹島の日)", since its assembly approved an ordinance establishing Takeshima Day in 2005. To my surprise, 10 members of National Diet participated in the ceremony, held in Matsue today, according to Sankei Shimbun. Though none of the official of Ministry of Foreign Affairs nor the Diet member of the ruling party joined, it's a great progress considering it was only 3 of them last year.

Oh, the Korean protesters came to Matsue and had a outdoor protests as always. You can see the usual member in the protest group. Check the video below out. But it looks Korean got less interested in Shimane's Takeshima Day gradually every year in the last 5 years.

1600s: "Dongyeo Bigo" (東輿備攷) Maps

The Dongyeo Bigo (東輿備攷) is a Korean atlas that is believed to have been compiled in the late 1600s, though there is an argument that it was made even earlier as a reference for the Dongguk Yeoji Seungram (東國輿地勝覽), which was published in 1486. The atlas has thirty-two maps, including historical maps that were meant to show geographical name changes though history.

Three of the maps in the Dongyeo Bigo show us how the name for the Korean island of Ulleungdo evolved from "Usando" (羽山島) during Korea's Three Han Period (before 300 A.D.), to "Usanguk" (羽山國) during Korea's Three Kingdoms period, and to Muleungdo/Usan (武陵島/于散) during the early Joseon period. One of the maps even appears to show Ulleungdo's neighboring island of Jukdo labeled as "Ulleungdo" (鬱陵島). Here are the three maps from the Dongyeo Bigo:

The above map shows the Korean peninsula during Korea's Three Kingdoms Period, which ended in 668 A.D. The map showsUlleungdo labeled as "Usanguk, now Ulleungdo" (羽山國 今欝陵島), which means Ulleungdo went from being called "Usando" (羽山島) to Usanguk (羽山國).

The above map shows two islands of the coast of Uljin (蔚珎). One island is labeled "Ulleungdo" (欝陵島) and the other is labeled Muleungdo (武陵島), with the phrase "also called 'Usan'" (一云 于山) written beside it.

In the 1400s, Ulleungdo was referred to as "Muleungdo" (武陵島), "Usando" (于山島), and Usan-Muleung (于山武陵). Muleungdo (武陵島) was also used to refer to Ulleungdo's neighboring island of Jukdo (竹島), which is only two kilometers off Ulleungdo's northeast shore. In the 1500s and 1600s, Korean maps showed Ulleungdo labeled as Usando (于山島) and its neighboring island of Jukdo (竹島) labeled as "Ulleungdo" (鬱陵島), though this was probably just confusion about which side of Ulleungdo the neighboring island was. By the end of the 1600s, however, the confusion seemed to have been cleared up because the main island of Ulleungdo was being labeled "Ulleungdo" (鬱陵島) and its neighboring island of Jukdo was being labeled "Usando" (于山島).

The fact that the above map shows both "Ulleungdo" (欝陵島) and "Muleungdo" (武陵島) suggests that it may have represented a time around the start of the 1500s, which was about the time the name "Muleungdo" switched back over to "Ulleungdo." The fact that the map shows the island to the west labeled "Muleungdo/Usan" (武陵島/于山) and the island to the northeast labeled "Ulleungdo" (欝陵島) suggests that, at the time the map was made, Ulleungdo was being referred to as both "Muleungdo" and "Usan" while its neighboring island of Jukdo was being referred to as "Ulleungdo." However, since the "Three Kingdoms Period" map had the phrase "Now called Ulleungdo" next to "Usanguk," we can assume that "Muleungdo/Usan" was referring to Ulleungdo's neighboring island, even though the map showed it to the west of Ulleungdo instead of the east. Nevertheless, the map suggests that Ulleungdo's neighboring island was referred to as both "Usando" and "Muleungdo" during the 1400s. By 1530, the name "Muleungdo" was replaced by "Ulleungdo," based on the following 1530 Korean map, which shows two islands beside each other. The one closer to the Korean coast was labeled "Usando" (于山島), and the one to its east labeled "Ulleungdo" (鬱陵島). The 1530 map below was not part of the Dongyeo Bigo.

1900 - Oct. 22 - A petition by 李乾夏 "鬱陵島를鬱島로改稱하고島監을郡守로改正에關한請議書", which excluded Dokdo from Uldo County.

3 days before the Ordinance NO.41 was promulgated, the petition for the ordinance was submitted by 李乾夏, a Minister of Internal Affairs of Korea, and it says that "the area of the island in concern(該島地方) should be 80 ris(32km) in length and 50 ris(20km) in the width." As we know, today's Takeshima(Korean call as Dokdo, meaning lonely island) is 92km far from Ulleungdo.

鬱陵島を鬱島と改称し、島監を郡守と改正することに関する請議書

  右該島は東溟に特立し大陸から遠隔であるが、開国504年に島監を設置して島民を保護し事務を管掌させており、島監裵季周の報牒と本部視察官禹用鼎、東萊稅務司の視察錄を參互節査したところ、該島地方は縦が八十里ほど、橫は五十里という。
 四圍壁の中に巨山があって北より南に至る。その間に大川あり、広さ深さは舟を幾つか容れることができ、その土は肥沃で民は素朴であり、この数十年、人口は蕃殖し、戸数は四百余戸あり、墾田は万余斗落ある。
  居民の農作一年の収量は、藷二万余包、大麦二万余包、 黃豆一万余包、小麦五千包という。大まかに戸数、田数と穀数を陸地の山郡と比較すれば、数は及ばないが甚しく劣るものでもない。
  最近、外国人が来て交易し、交際上のことも有り、島監と称するのでは行政上の障害もあるため、鬱陵島を鬱島と改称し島監を郡守に改正するのが妥当であるので、この段、勅令案を会議に提出する。

Three days later, based on this petition, Ulleungdo was promoted as Uldo County, one of the county of Gangwon Province by the Ordinance no. 41. This petition itself was made based on the inspection led by U Yong-jeong(禹用鼎) in June 1900, 4 month prior to the petition, while he didn't even hint about today's Takeshima in his report. From those Korean official documents, it is apparent that Seokdo(石島) in the ordinance is not today's Dokdo/Takeshima/Laincourt Rocks at all. There is absolutely no trace of today's Takeshima in those series of documents nor maps made by Korea.

In that sense, it is significant that皇 城新聞 reported that (the Korean Interior Ministry answered to Japanese Resident-General) "area under the authority of the Uldo County were sixty ris(24km) from east to west and forty ris(16km) from north to south for a total of 200 ri s(80km)", Because Ms. Yu had to make it clear how 禹用鼎, who was the official inspector from Interior Ministry, recognized the area of Uldo County, since 禹用鼎 was the one who inspected Ulleungdo in June 1900 and suggested that Ulleungdo to be promoted to the "Uludo County". The suggestion by 禹用鼎 actually lead to the promulgation of the Imperial Ordinance No.41.

However, the fact is, 禹用鼎's inspection area was limited to "the circumference of 140-150 ris(56-60km)", which is clearly Ulleungdo alone. This area clearly included Jukdo(竹島) and Sokdo(石島) as the petition by the Minister of Interior 李乾夏 stated as "The area of the island in concern(該島地方) should be 80 ris(32km) in length and 50 ris(20km) in the width.", the petiotion was submitted a day before the Imperial Ordinance was issued. Besides, the reason 禹用鼎 defined Ulleungdo as "the circumference of 140-150 ris(56-60km)" is that he followed the definition by Lee Gyu-won(李奎遠), who was sent to inspect on Ulleungdo in 1882 by the order of Kojong(高宗), that Ulleungdo is "the circumference of 140-150 ris(56-60km)." Their geographical recognition of Ulleungdo reflect on the map "欝陵島外図" by Lee, who was ordered to draw the precise map of Ulleungdo by Kojong. The map "欝陵島外図" depicted Jukdo(竹島, Japanese name 竹嶼) and Do-hang(島項), and it made the range of Ulluengdo, which is supposed to be "the circumference of 140-150 ris(56-60km)" clear. This is strongly supported by the petition which was submitted by 李乾夏, a Minister of Internal Affairs of Korea, 3 days before the Ordinance NO.41 was promulgated. Since it specified Ullengdo, which later became Uldo County, has "80 ri(32km) in length and 50 ri(20km) in width" and its special products are "potatoes, barley, soybeans and wheat." In those years, major industries on Ulleungdo were agriculture and fishery were extremely as minor as harvesting seaweeds around on the shore around Ulleungdo. This is also proved by the report of inspector U Yong-jeong(禹用鼎) in June 1900, which lead Ulleungdo promoted as one of the county of Gangwon Province 4 months later. In his report "Uldo-gi(鬱島記)", U wrote that "its agricultural products were barleys, wheats, soy beans and sweet potatoes." and "fisheries were mainly harvesting seaweeds." As we can clearly see from this, on Ulleungdo in 1900, agriculture was the residents' legitimate occupation, while fishery were only for harvesting seaweeds. Islanders on Ulleungdo only started to voyage to Takeshima/Dokdo when they were hired by Japanese fishermen who began hunting sealions in earnest on Takeshima/Dokdo, which was 4 years after the Imperial Ordinance were promulgated.

Moreover, the area which U inspected was limited to "the circumference 140-150 ris (56-60 km)(周廻一百四五十里)", which means the area was Ulleungdo alone and he didn't go to Takeshima/Dokdo at all. This is because, for Korean, the territorial sphere for Ulleungdo were already established as InspectorLee Gyu-won(李奎遠), who inspected Ulleungdo in 1883, had already wrote that Ulleungdo has "the circumference 140-150 ris (56-60 km)(周廻一百四五十里)". Then Lee defined neighboring islands of Ulleungdo as 竹島(Jukdo) and 島項( It was later changed to "鼠項島", whose pronunciation resembles to "Seokdo" very much. ) altogether and those two are small islands within 2km or so from Ullgungdo. If Korean really wants to claim this Seokdo(石島) was today's takeshima, she needs to prove their theory with concrete evidence based on first-hand historical source, not speculation.

Whatever the Seokdo in the Imperial Order no.41(大韓勅令第41号 ) was, it was absolutely not today's Takeshima/Dokdo/Liancourt Rock. That's for sure.

Three Kingdoms Map from 1600's

The following map is entitled "Map of the Original Regions of Silla, Goguryeo, & Baeje" (新羅高勾麗百濟肇造區域之圖) and is from an atlas entitled "Dongyeo Bigo (東輿備攷)," which is believed to have been compiled sometime in the mid to late 1600s. The map below is one of thirty-two maps in the atlas, which is believed to have been made to aid in the understanding of "Dongguk Yeoji Seungram" (東國輿地勝覽) . The atlas is stored at Daeseong Hermitage (大成庵) in the South Gyeongsang Province city of Yangsan (梁山). The map is very similar to THIS MAP.

The map shows an island off the east coast labeled "Usan-guk - Now Ulleungdo" (羽山國 今 陵島). This is evidence that Usan-guk was just a reference to Ulleungdo and did not include "Dokdo" (Liancourt Rocks).

Korean Finally "Discovers" 1905 Japanese Newspaper Article

Korea's Maeil Economics newspaper reports in a February 9, 2010 article that a Korean professor has discovered a 1905 Japanese newspaper article reporting Japan's incorporation of Takeshima (Dokdo). The Korean article, entitled "Japanese Empire, Dokdo's Seizure Announced Domestically through Newspaper," quotes Professor Kim Mun-gil (金文吉) of Busan Foreign Language University (see photo) as saying the following:

"Recently, I have discovered evident in Japan's Shimane Prefecture Library that the Japanese government tried to inform its people, by way of newspaper, of its incorporation of Dokdo as Japanese territory."

"최근 일본 시마네현 도서관에서 일본정부가 독도를 일본영토로 한다는 사실을 신문을 통해 국민들에게 알리려고 했다는 증거를 발견했다."

The 1905 Japanese newspaper article that the Korean professor has only "recently discovered" is the same article that we wrote about on this blog in 2007. If he had only come HERE and read our post three years ago, the professor could have "discovered" the article much sooner.

Koreans have been claiming for years that the Japanese government in 1905 tried to keep the incorporation of Takeshima a secret, supposedly because Japan did not want the world to know that she was stealing Korean land. Now, in an article that is trying to make some kind of news out of the fact that the Japanese article referred to Takeshima as "Oki's new island," Koreans are inadvertently admitting that the incorporation of Takeshima was made public in 1905.

By the way, the 1905 Japanese article was entitled "Oki's New Island" (隠岐の新島), not "Japan's New Island." The title only meant to say that Takeshima was officially put under the jurisdiction of Oki County, not that it was a new Japanese island, which is what the Korean article seems to be trying to imply.

Land, especially a few barren rock islets, can be considered a part of a country's territory without being put under the administration of a local government. For example, the United States and other countries have what are now called "unincorporated, unorganized territories." Before its incorporation in 1905, Takeshima seems to have been considered such a territory by Japan, as this 1877 letter from an official of Japan's Ministry of Foreign Affairs suggests. Here is an excerpt from the 1877 letter:
Many records say that “Argonaut,” which is the Western name for Takeshima (Ulleungdo), does not exist, and that “Dagelet,” which refers to Matsushima, is actually Takeshima (Ulleungdo). So what we call "Matsushima” (Liancourt Rocks) is called “Hornet Rocks” by Westerners. Foreign maps show Hornet Rocks to be Japanese territory, but there is still no agreement among countries concerning the other two islands.
Japan has many old maps showing Takeshima as Japanese territory, but Korea has none showing it as Korean territory. Takeshima before 1905 appears to have been considered unincorporated Japanese territory, but in 1905, it was formally incorporated, as is evident by the 1905 Japanese article mentioned above.

I do not support Korea's "East Sea" movement.

Today, I got an E-mail from someone asking me to include the name "East Sea" next to "Sea of Japan" in my "Purpose of this Blog" introduction. I refused by responding as follows:

I do not support the Korean movement to rename the "Sea of Japan" to the "East Sea," just as I would not support a movement to rename the "Gulf of Mexico" or any other standardized geographic name. Why make geography more confusing than it already is?

I see Korea's "East Sea" movement as a nationalistic, anti-Japanese movement. If it were not anti-Japanese, then Koreans would be pushing equally as hard to change the name "Yellow Sea" to the "West Sea."

Koreans may not realize it, but their campaign to change the name of the Sea of Japan looks pretty silly to the rest of the world, and I would advise them to stop it.
I may reconsider my stance when I start seeing a majority of Korea's Web sites and maps using the name "Sea of Japan" alongside the name "East Sea."

"Rie Akiba angers Korean netizens with Dokdo"

According to THIS ARTICLE, Korean "netizens" are angry at Rie Akiba over a comment she made about "Dokdo." Rie is the Japanese member of a panel of foreign women that are featured on a weekly Korean talk show. The women are asked their opinions on a variety of topics generally concerning Korea. The women respond in Korean with varying degrees of fluency.

Rie said that when she is asked her opinion on "Dokdo," she usually dodges the question by turning it around and asking the questioner his or her opinion, instead. She also asks why he or she has that opinion and where the questioner got the opinion.

The best answer Rie could have given would have been, "I don't want to talk about Dokdo," but the second best answer was probably the one she gave because if a foreigner gives an opinion different from the Korean opinion on Dokdo, the foreigner is generally crucified in Korea. If Rie had not said anything more about Dokdo, I think she would have been all right, but she added the following:
I have actually done some research on Dokdo. Korea first found it, but I cannot say for sure which country it belongs to. Korean people first found it, but the first people to name it were the Japanese.
First, there is no evidence to suggest that Koreans were the first to find "Dokdo." All the evidence shows that the Japanese were the first to both find and name the island, which was first named "Matsushima" and later "Takeshima." Second, there are maps and documents proving that the Japanese were visiting "Dokdo" (Takeshima) as far back as the 1600s, but Korea has no evidence of Koreans visiting the island before the Japanese started taking them there on Japanese fishing boats in the early 1900s. Also, the Korean name for the island, "Dokdo," does not appear before the early 1900s.
If Rie had really researched the isssue, then I cannot understand how she could come to the conclusion that Koreans were the first to find Dokdo. Did she use Korean or Japanese sources? Is the history really that poorly explained in Japan?
I wonder if Rie really believes that "Dokdo" (Takeshima) was first found by Korea or if she only said that in a failed attempt to be diplomatic and avoid crucifixion?

5 鬱陵島開拓と独島帰属
鬱陵島所属問題が解決した以後も、わが国では以前のように空島政策をとり、鬱陵島に人が入って居住することを禁止し、しばしば捜討官を派遣してこれを管理した。大体一年おきに一回ずつ平海郡守あるいは蔚珍県令を捜討官に任命して居民の有無を巡審し、本島特産の香木、竹、山蔘などを採取し、カジェ(可支)を捕まえて来たが、特に鬱陵島の香は有名であり、ソウルの宰相家で非常に愛用した。そして徳川幕府でも、竹島(鬱陵島)を朝鮮領土と認定した後、日本漁民の往来を厳禁し、憲宗三年(西紀1837 日本天保八年)に秘密に鬱陵島に入り伐本(訳注:伐木か)した浜田の巨商・無宿八衛門を捕えて死刑に処し我が国に対する約束を厳守したが、明治維新以後、日本政府が従来の鎖国政策を捨てて国民の海外進出を奨励するようになると、日本人は空島であった鬱陵島に着眼し、これを松島と呼んで外務省に松島開拓願を提出したこともあり(武藤學平(訳注:武藤平學の誤)、児玉真易など)、密かにここに行き、千古手付かずの鬱蒼たる山林を採伐する者もいた。しかし、わが国ではこのような事実を全然知らずにいた。高宗十八年(1881 日本明治十四年)5月に、鬱陵島捜討官が本島で伐木している日本人7名を発見し政府に報告したため、政府では初めて日本人が密航する事実を知り、礼曹をして粛宗時代の約束された事実をもって日本の外務卿代理・上野景範に厳重な抗議を提出させると同時に、副護軍・李奎遠を鬱陵島検察使に任命して鬱陵島の形勢を調査し、従来の空島政策を変更してこの島を開拓することに決定し入住者を募集した。

このように、鬱陵島開拓令が発布され、五百年間かたく閉ざされていた門が開かれると、江原道、慶尚道沿岸の人たちは言うまでもなく、遠く全羅道地方からも移住する人が多く現われ、鬱陵島の山野はその歳に開拓され、翌年島長を設置し、光武五年(1901)に島長を郡守に昇格させたので(訳注:1900年の誤)、鬱陵島の開拓と同時に独島もわが国の所有となり鬱陵島の人たちが多くこれを利用した。鬱陵島庁に保管されている光武十年丙午陰三月五日付 鬱陵郡守・沈興澤の報告書の冒頭に「本郡所属獨島」という言葉があり、梅泉野録 巻五光武十年丙午4月5日条に「鬱陵島の東の百里の海上にひとつの島があり、獨島という。昔は鬱陵島に属していたが、倭人が強引にその領土だとして審査して行った。(距鬱陵島洋東百里、有一島、曰獨島、旧属鬱陵島、倭人勒稱其地、審査而去)」と記録されている。この二つの記録により、日本が独島を強奪する前に独島がわが国の領土だということは確実に証明することができるのであるが、鬱陵島開拓当時に江陵から移住したという鬱陵島の古老、洪在現氏の言によれば(洪氏は第一次学術調査当時、筆者が直接お会いした方であるが、当時85歳の老人であった)鬱陵島開拓当時、鬱陵島の人はすぐにこの島を発見し、あるいはコンブ、アワビをとるために、あるいはカジェをとるために、何度も独島に出漁したということで、洪氏自身も十数回来往したと話していた。独島は日気が清明な日、鬱陵島から眺めることが出来る島であるから、鬱陵島開拓当時の人がこの島を発見しないことはありえず、彼らがしばしばこの島を利用したのは当然のことであり、この事実は日本海軍省で発行した朝鮮沿岸水路誌(第三編 鬱陵島及竹島)にも次のように明白に記録されている。
「(前略)島上には家屋を建築できる場所は極めて少なく、明治三十七年十一月に軍艦対馬がこの島を実測するとき、東方島に漁夫用の菰草小屋があったが、風浪のためにひどく破壊してしまったという。毎年、夏になると海驢を捕まえるために鬱陵島からこの島へ来る者が数十名の多数に達する時がある。彼らは島上に小屋を建て、毎回約十日間仮居するという。」

この記事は、日本が独島を強奪する1年前の1904年、(光武八年 明治三十七年)に日本の軍艦対馬号が独島を調査した時に、鬱陵島の漁民が毎年夏数十名ずつこの島へ来て、・・で・・した小さな家を建てて十余日ずつ滞在し、カジェ(海驢)を捕っているのを見て記録したもので、独島が鬱陵島の人たちによって最も効果的に利用されたわが国の領土であったことを証明する重要な資料の一つである。日本政府は1954年2月10日付けの覚書で、ここに記録された鬱陵島の漁民は、日本人と日本人に雇用された朝鮮人であるとして、我々の主張を反駁したが、日本人が鬱陵島に居住するようになったのは、1910年、韓日合邦以後、または1905年保護条約締結以後のことであったので、対馬号が独島を調査した1904年には、まだ一人の日本人も鬱陵島に住んでいなかった。よって日本政府の見解は成立し得ないものである。(訳注:この「日本人が鬱陵島に居住するようになったのは」以降の記述は、申奭鎬のまったくの事実誤認)

以上説明したことでも、独島が韓国の領土であったということを充分に証明したといえるのであるが、この他に、2つのより重要な日本側の記録を上げることが出来る。一つは、1923年(大正12年)島根県教育会で編纂発行した島根県志であり、その中に独島を貸下するために日本領土に編入することを猛烈に運動した島根県人の中井養三郎が、独島は韓国領土と信じていたために東京に行き、韓国政府からその島の譲渡を獲得するため、農商省(訳注:務が欠か)に交渉しようとしたというもので、もう一つは1905年(明治38年)に発行した田淵友彦の韓国新地志(訳注:韓国新地理の誤)(帝国百科全書第134編)で、独島を鬱陵島とともに韓国領土と明記したものだ。中井養三郎の活動については次項でまた論ずるが、「彼は独島を韓国の領土と信じていたため、東京に行き韓国政府からその島の譲渡を獲得するために農商務省で交渉した」ということは、独島が本来韓国領土だという確証して余りあるものである。そして田淵友彦の韓国新地理は、日本が独島を島根県に編入して半年後に発行した本である。日本が独島を島根県に編入したのが1905年2月22日であり、この本の発行の日付が同年9月9日である。それなら、この本の原稿は独島を島根県に編入する前後のいつかに執筆されたものであろう。万一、著者が独島を島根県に編入したことを知っていれば、これが日本領土だったのであれば、著者はこれを韓国新地志から除去したはずである。ところがこれを我が国の領土として記録したのであるから、古来、独島は韓国の領土として日本に広く知られていたことを、また証明するものである。

以上のように、独島は鬱陵島開拓以後、鬱陵島の人たちが最も効果的に利用した名実相符のわが国の領土であったが、日本は1905年(光武九年 明治38年)2月22日付の島根県告示第40号で、これを竹島と称し島根県に編入した。これより先、1903年9月29日に、島根県人・中井養三郎が、独島で海驢を捕まえることが有利な事業であることを知り、竹島領土編入及貸下願を内務・外務・農商務の3大臣に提出したが(訳注:1904年の誤)、日本政府は長い間これを処決していないでいたのが、1905年1月28日の内閣会議で竹島を日本領土に編入することを決定し、同年2月22日付け島根県告示でこれを発表したのである。島根県志の中に「中井は竹島を朝鮮領土と信じていたために、東京に行き韓国政府に島嶼の譲渡を申請することを彼に許可するように農商務省に説得しようとした」という記事があるが、これはたぶん日本政府も竹島を韓国領土と知っていて中井の許可願を処理しなかったため、中井は東京に上がり、彼に韓国政府に申請させてくれるようにと農商務省に交渉したようである。要するに、独島が韓国の領土であるために、日本政府は1903年9月29日に提出した中井の「竹島領土編入及貸下願」を長い間処理しないでいたが、1904年(明治37年)2月6日に露日戦争が起こり、日本軍が我が国に上陸したのと同時に、同月23日に韓日議定書を締結し、我が国の土地を思いのままに収用し、同年8月22日に第一韓日協約を締結し、わが国政府の各部に日本人あるいは日本人が推薦する外国人の顧問官を設置し、我が国の内政外交を思いのままに処置できたので、1905年2月22日に独島を島根県に附属せしめ、中井に独島の海驢捕獲権を許可し、1906年すなわち光武十年4月8日(陰3月4日)、隠岐島司・東文輔など十余名の官員を鬱陵島に送り、郡守・沈興澤に独島が日本領土に決定されたということを通告した。鬱陵島唯一の属島でありカジェ(可支)の産地として有名な独島を失うことになった鬱陵郡守・沈興澤は、光武十年丙午三月五日付で次のような報告書を作成して政府に上申した。

本郡所屬 獨島가 在於本郡外洋百里이읍드니 本月初四일辰時量에 輸船一隻이 來泊于郡内道洞浦、而日本官人一行이 到于官舎하여 自云 獨島가 今為日本領地 故로 視察次 来島이다인 바 其一行 則日本島根縣 隠岐島司東文輔 及事務官神田西由太郎 税務監督局長吉田平吾 分署長警部影山岩八郎 巡査一人 會議員一人 醫師、技手各一人、其外随行者十餘人이 先問戸總・人口・土地及生産多少라고 次問人員及経費幾許 諸般事務를 以調査樣으로 録去이암기 茲以報告하오니 照亮하심을 務望함

この報告書は、鬱陵島庁に保管されている副本を転載したものである。海泉野録(訳注:梅泉野録の誤)にも、前項ですでに引用したように光武十年丙午四月条に倭人が強引に独島を日本領土だと言って審査していったという記事があることを見ると、この沈興澤の報告書は中央に報告され新聞にも報道されたようだ。なぜなら海泉野録は、黄玹が全羅南道の求礼で主に皇城新聞と大韓毎日申報を見て記述したものであるからだ。わが国政府ではこの問題をどのように処理したかわからないが、この時露日戦争は決定的段階に到達し、日本の勝利がほぼ確定し、このため韓国に対する日本の圧力がより加わって、国家全体の運命が重大な危機に直面しており、政府は独島のような小さな無人の孤島についてかえりみる余裕が無かっただけでなく、抗争する能力も無く、また親日米国人スティブンス(stivns ママ)が外交顧問官としていたために、たぶんこの問題は黙殺されてしまったのだろう。

以上のように、日本は独島を強奪したが、地理上独島は日本の隠岐島から60浬(ママ)、島根県のサカイ(境)市(訳注:鳥取県の誤)から130浬にもなる遠い距離にあり、わが国の鬱陵島からは僅かに49浬にしかならない近い距離にあることから、日本が独島を強奪した後にも日本人よりも鬱陵島の人たちがより効果的に利用した。このため日本人たちは、大概この島を朝鮮の所属と認識した。1930年(昭和五年)6月に発行した『歴史地理』(第55巻第6号)に載せられている樋烟雪湖(訳注:樋畑雪湖の誤)の「日本海にある竹島の日鮮関係について」という小論文に、竹島と鬱陵島はいま朝鮮江原道に属し、朝鮮の領土であり、日本海の最東端に属している」と記録されて独島は朝鮮領土であると認定されており、日本政府各機関で編纂した韓国水産誌と朝鮮沿岸水路誌もまた、これを朝鮮の所属と記録した。韓国水産誌は日本が独島を強奪してから3年後の隆熙二年(1908)に、韓国政府の農商工部に□用(訳注:一字欠。任用か)された水産課長・庵原文一など、日本人官吏が総出動して韓国に属する島を一つ残らず実地踏査し、その位置と地勢、産物などを細密に調査した後、編纂出版した本であり、その第1輯水路告示条に竹島すなわち独島を記録し、朝鮮の属島と認定した。朝鮮沿岸水路誌は、1923年(訳注:1933年の誤)(昭和八年)に日本海軍省で発刊した本で、これも朝鮮に附属する島を総網羅し、その位置と地勢および産物を記録したものであるが、その第三編朝鮮東海岸に鬱陵島と竹島を記述し、独島を朝鮮に付属する島と認定した。ところで日本海軍省から朝鮮沿水路志(訳注:朝鮮沿岸水路誌の誤か)と同時に発刊した本州沿岸水路(訳注:本州沿海水路志の誤か)第二巻日本海沿岸にも竹島が載せられているが、朝鮮沿岸水路志に載せられている竹島の記事と比較すれば差異が大きい。朝鮮沿岸水路志には、竹島の位置や地勢および産物を詳細に記録しているのに対し、本州沿岸水路志にはただ竹島の名称のみが載せられているだけである。これは竹島すなわち独島が昔から朝鮮に属する島であり、地理的に朝鮮に付属させることが合理的だからである。

結論
以上を要約すれば、独島は、朝鮮初期に于山島、または三峯島と呼んでいたわが国の領土であり、世宗実録地理志と成宗実録、東国輿地勝覧などの古文献に明記されたところであり、粛宗時代に鬱陵所属問題が起こったとき、安龍福の特別な活動によって日本が鬱陵島とともに子山島(于山島)すなわち独島もわが国の領土として承認したもので、これは粛宗実録と文献備考、通文館志に明記されているところであるが、高宗時代に鬱陵島を開拓した以後、鬱陵島の属島として鬱陵島の人たちにより最も効果的に利用された名実相符のわが国の領土であることは、我が国の史料である鬱陵郡守沈興澤の報告書と梅泉野録に記載されているだけでなく、日本側の史料である朝鮮沿岸水路誌と韓国水産誌、島根県志、田淵友彦の韓国新地志などに明記されたところで、少しも疑う余地のないところである。ところが、日本はこのような歴史的事実を無視して、ただ1905年2月22日付の島根県告示で独島を日本領土に編入したことを合法的であるとして、国際法を持ち出してその領土権を主張しているのである。私は法律には門外漢で法的条文と解釈はわからないが、他人の国の領土を、相対国と何等の商議もなく、一介の地方官署の告示で自己の領土に編入するということは、常識に反する不法な行動であるばかりでなく、独島編入当時の両国の政治的関係を考える時、実に強盗行為としか言いようのないものである。前にすでに説明したように、日本は島根県人の中井養三郎が「竹島領土編入及貸下願」を提出したので1905年2月22日に独島を島根県に編入したものであるが、中井が編入願を提出したのはこれより一年半前の1903年9月29日である。(訳注:1904年の誤であり、実際には半年前である)万一、独島が本来から日本の領土であったのなら、中井が願書を提出した時にすぐにこれを許諾したことであろう。これが韓国領土であるために許諾せずにいたが、露日戦争が起こり韓国を完全に支配した時にこれを一個の地方官署の告示で編入したのだから、強盗行為でなければ詐欺行為と言うべきものである。(終)

"South Korean Government dug their own grave by publishing the English version of "The Dokdo/Takeshima Controversy" by Prof. Emeritus Naito Seichu and Mr. Park Byeong-seop.”

On Nov. 4th, the National Assembly Library of South Korea released an English-translated version of the book titled "The Dokdo/Takeshima Controversy" by Naito Seichu, a Emeritus Professor of Shimane University and Mr. Park Byeong-seop. The book was already published by Shinkansha in Japan in March, 2007 and Korean version was published in March 2008 in South Korea. This English version is assumed to be "Part of the books excavation and the translation business promoted to share a historical fact that relates to Dokdo with the international society" and was published according to the instruction of Mr. Kim Hyong-o(金炯旿) who is a chairperson of the Diet of South Korea.Mr. Park Byoung-sup, whom Yonhap News Agency introduced as "a Korean Dokdo specialist residing permanently in Japan and a representative of "Takeshima = Dokdo research network", along with Naito Seichu, who serves as a emeritus professor at Shimane University in Japan, has been repeated baseless criticism/slander, such as "Criticism on Masao Shimojo" and "Criticism on Funasugi Rikinobu", through his "newsletter of half-moon"(半月城通信) and so on.

However, that is not the conclusion derived through the proper document criticism. If we look into the historical details why Takeshima, that had been named Matsushima in Edo period, was not named Matsushima but Takeshima in 1905, it explains naturally that today's Takeshima (Liancourt Rocks) was not mentioned inDajokan Order.

On Nov. 15, 1904, Hori Shinji(堀信次), a secretary of the office of interior of Shimane Prefecture, inquired Higashi Bunsuke(東文輔), a Oki island governor, in regard to the naming of Takeshima, that had been called as "Ryanko". ("島嶼の命名に付、併せて御意見承知致度、此段及照会候也"). In reference to this, Higashi answered as follows.

However, there is a fatal defect in "The Dokdo/Takeshima Controversy". The authors seems to be under misapprehension that they had confuted Japanese claim by holding up only the points at issue which hardly influence the dispute over sovereignty of Takeshima.

In conclusion, publishing the English version of "The Dokdo/Takeshima Controversy" made South Korea disgrace herself in public, to all over the world, to expose the evidence that they have fabricated the false history by a groundless documents and cheated the international society.

This time, his baseless claim was published and distributed to "the National Diet Libraries, diplomatic establishments, cultural academies in the United States, Germany and each countries plus foreign embassies in South Korea, and 326 of Library of Congress and Center for International Exchange, as well. Mr. Park's and Naito's true value is now exposed to the world under public scrutiny. Korean government, who distributed this "controversial" book to the world, drove herself into getting judged by the Historical Court of Justice before judgement by International Court of Justice they refused to go. However, the points of issue this book focused were criticism on the theory of "Inherent territory of Japan" by Ministry of Foreign Affairs of Japan and the instruction byDajokan , which said "Takeshima and another island is nothing to do with Japan" in 1877. If we look into these two points, the truth will come out of their own accord.

Prof. Naito's criticism on "the theory of Inherent part of the territory of Japan" started when Shimane Prefecture assembly enacted "Takeshima Day" ordinance on March 16, 2005, and Japanese MOFA wrote Takeshima as "the inherent territory of Japan" on its website. Prof. Naito criticized the theory of "the inherent territory of Japan" by MOFA by the article "Was Takeshima a Inherent territory of Japan?" published in 'World(世界)' magazine (June 2005 issue), and "Problem of the Takeshima as inherent territory theory" was announced in the No.69 edition of 'Hometown Iwami(郷土石見)' (August, 2005). His criticism on MOFA was compiled in the book " The compilation of translated articles on Dokdo, vol. I (独島論文翻訳撰I)" published by South Korean governmental organization, 東北アジアの平和のための正しい歴史定立企画団( Northeast Asian History Foundation's former organization) on Dec. 2005, and it became Korea's crucial point of argument for offending Japan.

However, no matter how they criticize Ministry of Foreign Affairs of Japan, South Korea's illegal occupancy of Takeshima never be justified as long as Korea keeps failing to show the evidence for their sovereignty on Takeshima/Liancourt Rocks/Dokdo til today. They have no rights to criticize Japan since Meiji government simply incorporated the island, which had never been Korean territory, into Shimane. Moreover, when Japanese Meiji government named the uninhabited island as Takeshima, they noted that "there were no traces of occupation by any other countries" so they "examined the matter and found that there is a fact of occupation (by Japanese) under the international law". This is one of the reason Japan claim the island as "inherent territory of Japan". Nevertheless, Prof.Naito criticizes MOFA since he stands on the assumption that Takeshima was Korean and twists that Japan had " invaded" it only because the incorporation was done in the middle of Japan-Russo war. It is not a right attitude for a researcher as it is same as interpreting the document through the one-sided preoccupation of the history.

The logical base Prof. Naito and Mr. Park rely on was the Dajokan Order in 1877, which says that "Takeshima and the other island has nothing to do with Japan." They call the incorporation as invasion since they misinterpreted "the other island" as today's Takeshima, and considered thatDajokan, the highest governmental organ of Japan, instructed that today's Takeshima is nothing to do with Japan.

"Originally, according to the folklore of populace, it is known that there are both Matsu/Take islands on the sea to the east of Joseon. However, up to now, Ulleungdo, which woodcutters and pioneers(樵耕者) from our area come and go, had been commonly known as Takeshima, but in fact the island in question is apparently Matsushima according to sea chart. In that case, there is no island to be applicable to the name of Takeshima except for this new island. Therefore, I take it for granted that we should divert this name(Takeshima), which we had been wrongfully called hitherto, to the name of the new island. (元来朝鮮の東方海上に松竹両島の存在するは一般口碑の伝ふる所、而して従来当地方より樵耕者の往来する欝陵島を竹島と通称するも、其実は松島にして海図 によるも瞭然たる次第に有之候。左すれば此新島を措いて他に竹島に該当すべきもの無之。依て従来誤称したる名称を転用し、竹島の通称を新島に冠せしめ候方 可然と存候)"

The reason Higashi, who was the governor of the Oki island, mentioned " in fact the island in question is apparently Matsushima according to sea chart" was because on the sea charts etc. published around the year ofDajokan Order in 1877, Takeshima(Argonaut), which the existence was not clear, and Matsushima(Daglet ), which in fact was Ulleungdo, were depicted. This is caused by the western maps which wrongfully located and named Takeshima and Matsushima according to Siebold's "the Map of Japan"(1840). "the Map of Japan"(1840) by Phillipp Franz Siebold applied the names Takeshima (Ulleungdo) to the non existent Argonaut and Matsushima to Dagelet or the real Ulleungdo island. This mistake was passed to the Japanese cartographers and made them depict Ulleungdo as Matsushima on sea charts and maps circulating in Japan. In other word, Matsushima which was mentioned as "another island" inDajokan Order in 1877, indicated Ulleungdo(Daglet), not today's Takeshima/Liancourt Rocks.

On the other hand, Liancourt Rocks, which was named as Takeshima and incorporated into Shimane in 1905, was found by a French ship, Liancourt, in 1949. And the 1864 edition of Admiralty Chart of Royal Navy mapped Takeshima(Argonaut), Matsushima(Ulleungdo), plus Liancourt Rocks(today's Takeshima). Among three islands, Takeshima(Argonaut) of unconfirmed whereabouts disappeared from 1876 edition of Royal Navy's sea-chart when it comes to sea-charts, and since then, Matsushima(Ulleungdo) and Liancourt Rocks were depicted. Therefore, Takeshima of today is not drawn though Takeshima (Argonaut) and Matsushima (Dagelet) are drawn in the maps produced referring to the sea-charts before 1876 versions.

Japanese government finally realized this mistakes on the result of survey around Ulleungdo by the Warship Amagi in Sep. 1880. Kitazawa(北澤正誠), who was a non-regular employee of the Ministry of Foreign Affairs, adopted this results of Amagi's survey in his book "A Study of Historical Evidence of Takeshima(竹島考証)" and "A Study of Historical Evidence of Territorial Issue of Takeshima(竹島版図所属考)", and they concluded that Matsushima, which was referred as "the other island(外一島)" so far was certainly a Ulleungdo. And Ulleungdo was called as Matsushima thereafter. This fact indicates that "the other island" in Dajokan Order in 1877, which said that Takeshima and other island has nothing to do with Japan, was not Takeshima/Liancourt Rocks but Ulleungdo.

Prof. Naito disregarded this fact and takes no assumption "the other island" was Takeshima of today every-time he see the Dajokan Order in 1877 and fabricated the false history, saying Dajokan, the supreme policy making authority, ordered Takeshima has nothing to do with Japan. However, as we had already seen, Prof. Naito's interpretation of the document is baseless, since
Matsushima and Takeshima in 1877 Dajokan Order was identified as Ulleungdo and Jukdo(竹嶼, Korean name 竹島), which locates near Ulleungdo, respectively as a result of the survey done by warship Amagi in 1880.

This accurate/precise information and image of Ulleungdo was passed to Joseon, and in June,1882, Ulleungdo inspector Lee Gyu-on adopted this information and depicted Ulleungdo as Matsushima and Jukdo(Japanese call it as 竹嶼) as Takeshima(竹島) on his "Map of around Ulleungdo(欝陵島外図)". In next year, Nov. 1883, Higaki Naoe(檜垣直枝), a Junior secretary of the Ministry of Interior of Japan, submitted the report of his business trip to Ulleungdo, and Korean map of Ulleungdo was attached to it. This map reassured Matsushima in 1877 Dajokan Order, which said Matsushima as "Takeshima and other island", was Ulleungdo, not Takeshima of today. Meiji government based on "A Study of Historical Evidence of Territorial Issue of Takeshima" by Kitazawa at the time.

Consequently, according to the historical facts stated so far in this article, it is clear that Dajokan Order("Takeshima and another island has nothing to do with Japan") in 1877 doesn't include Takeshima of today. Therefore, there is no historical base for Prof.Naito's theory that Japanese government excluded Takeshima from its territory by Dajokan Order in 1877 and "invaded" the island in the middle of Japan-Russo war in 1905.

Additionally, Prof. Naito's criticism on "Theory of Inherent Part of the territory (of Japan)(固有の領土論)" is a totally groundless lie as well. The concept of "Inherent Part of territory(固有の領土)" indicates the territory which was yet to be occupied by other counties, just like northern territories of Japan (北方領土). What really happened was on January 28, 1905, Japanese government examined the matter and assured that " there were no traces of occupation by any other countries" and "there is a fact of occupation under the international law as it is clear from related documents" when they decide to incorporate Takeshima today into Shimane.

So far, Korean has been failing to prove Dokdo/Takeshima was their territory historically even after more than half century since they had invaded Takeshima. Under this cicumstance, it's absolutely meaningless for Prof. Naito to censure "Theory of Inherent Territory of Japan" by Japanese Ministry of Foreign Affairs.

Therefore, South Korea, who included Takeshima inside Lee line and keeps illegal occupation of Japanese Takeshima until now, definitely deserves to be dubbed "An Aggressor Nation", while it is absolutelyunpardonable for them, who distort the history in order to claim the sovereignty over Takeshima/Dokdo, to accuse Japan falsely for aggressor .

On the occasion of publishing the English version of "The Dokdo/Takeshima Controversy", Mr. 柳鍾珌. the head of the National Diet Library, commented that "The international society correctly recognizes a historical fact and information on Dokdo through this book". However, against his will, all this book does is to advertise the distorted history for concealing the fact of the illegal occupancy by South Korea. If there is any patriotic sentiment in Korean's mind, I would say that they should collect the book right away in order to not disgrace the honorable history of the Republic of Korea anymore.
